1. Acceptance of terms
By accessing or using the Qraalys platform, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you may not use the platform.
2. Description of service
Qraalys provides a fleet intelligence platform including real-time GPS tracking, trip history, driver behaviour scoring, fuel monitoring, and geofence alerts. The service is provided through a network of authorised partners.
3. Partner programme
Partners who resell the Qraalys platform must comply with the Partner Programme Agreement provided upon approval. Partners are responsible for their client relationships, billing, and support within their territory.
4. Payment terms
Payments are processed through Pesapal. Fees are charged per device per month as set out in the applicable rate card. All fees are non-refundable except as required by law.
5. Acceptable use
You may not use the platform for unlawful surveillance, tracking individuals without consent, or any activity that violates applicable law. You are responsible for ensuring your use complies with local privacy and data-protection regulations.
6. Intellectual property
All platform software, trademarks, and content are the property of Qraalys or its licensors. Nothing in these terms grants you any right to use our intellectual property other than as permitted for normal use of the service.
7. Disclaimers and limitation of liability
The platform is provided 'as is' without warranties of any kind. To the fullest extent permitted by law, Qraalys's liability for any claim arising under these terms is limited to the fees paid in the three months preceding the claim.
8. Governing law
These terms are governed by the laws of Kenya. Disputes shall be resolved through the courts of Nairobi, Kenya.
9. Changes to terms
We may update these terms from time to time. Material changes will be notified via email to registered partners. Continued use of the platform after changes take effect constitutes acceptance.
